Sentencing for all offences for assault are clearly on the increase. The 'cowards punch' legislation interstate is receiving a lot of interest in this state. In November 2014, Parliament passed legislation that if a person is sentenced to a term of imprisonment for a period of 2 years or more for manslaughter or an assault that causes serious harm then a wholly suspended sentence is not allowed. A person has to serve at least 20% of the non-parole period in gaol. That, of course, is significant and one foolish act of punching someone that causes serious injury or death changes not only the life or the victim but also the life of the accused. No longer will alcohol-fuelled violence be tolerated in the community and legal advice is essential.
